WYOMING SUPREME COURT DISBARS BUFFALO LAWYER

CHEYENNE–The Wyoming Supreme Court has issued an order disbarring Buffalo attorney Nick E. Beduhn from the practice of law. The order of disbarment is effective November 2, 2022, the date the Court previously issued an order of immediate suspension of Beduhn.

The disbarment resulted from Beduhn’s filing of a lawsuit in federal court. After filing the lawsuit, Beduhn had no further contact with his clients and took no further action in the case. Shortly after the lawsuit was filed, a U.S. Supreme Court opinion was issued directly addressing the subject matter of the lawsuit. Beduhn did not dismiss the lawsuit but also did not respond to the Motion to Dismiss or Motion for Sanctions filed against him and his clients. The lawsuit was dismissed and Beduhn was ordered to personally pay the opposing parties’ attorney’s fees. Beduhn did not inform his clients that the lawsuit was dismissed. Two complaints were filed about this conduct. Beduhn did not respond to either complaint despite repeated requests or participate in the case until the sanction hearing. Beduhn’s conduct violated Rule 1.1 (competence), Rule 1.3 (diligence), Rule 1.4 (communication), Rule 3.1 (meritorious claims and contentions), Rule 3.3 (candor toward the tribunal), Rule 3.4 (fairness to opposing counsel), Rule 8.1 (bar admission and disciplinary matters), and Rule 8.4(d) (conduct prejudicial to the administration of justice) of the Wyoming Rules of Professional Conduct. Beduhn was ordered to pay $1,435.14 in costs and fees to the Wyoming State Bar.
