Wyoming Supreme Court Suspends Casper Lawyer

CHEYENNE – The Wyoming Supreme Court has issued a 30-day order of suspension commencing April 1, 2019, to Casper attorney Donald L. Tolin.  Tolin represented a client in proceedings to establish paternity, custody, visitation and child support regarding the client’s young daughter.  Due to Tolin’s lack of diligence, the resolution of the paternity action was delayed by more than three years and Tolin’s client was unable to have contact with his daughter for more than two years.

In a hearing before the Board of Professional Responsibility of the Wyoming State Bar, the Board found that Tolin’s conduct in the paternity action violated Rules 1.3 (diligence), 1.4 (communication with client) and 3.2 (duty to expedite litigation) of the Wyoming Rules of Professional Conduct.  The Board filed a report and recommendation with the Court recommending that Tolin be suspended for a period of 30 days.  The Court affirmed the Board’s report and recommendation and ordered Tolin to pay an administrative fee of $750.00 and costs of $6,221.54 to the Wyoming State Bar.
