Step 1
Read the Wyoming Rules for Fee Arbitration, specifically Rule 1(f)(5) which addresses disputes not subject to arbitration. See Rule below.
Rule 1(f) “Disputes where the request for arbitration is filed more than one year after the lawyer-client relationship has been terminated or more than one year after the final billing has been received by the client, whichever is later, unless a civil action concerning the disputed amount is later brought by the lawyer, in which case the client shall have 30 days after service of the notice required by Rule 1(g) to file a Petition for Fee Arbitration.”
Step 2
Complete and print the Petition for Fee Arbitration. Information can be typed directly into each field; however, you will not be able to save the document. Navigate by using the tab key. Once you have completed the form, print, sign and mail/deliver it to the Wyoming State Bar, 4124 Laramie Street, Cheyenne, WY 82001. Your petition will not be processed until the signed original is received. Per Rule 1(f)(6) of the Wyoming Rules for Fee Arbitration, disputes in the amount of $500 or less are not subject to arbitration.
Please include copies of bills or other documents supporting your claim. Do not send original documents as they will not be returned to you.
Step 3
A copy of the petition will be forwarded to the attorney in question. The attorney has 20 days to respond. Upon receipt of the response, the Bar office will forward the petition and response to the Fee Arbitration Committee Chair for review to explore the possibility of an informal resolution.
Step 4
If an informal resolution is unsuccessful within 21 days, the chair shall appoint a panel and mail to the parties written notification of the name(s) of the panel member(s) assigned to hear the matter. The panel will set the date, time and place for the hearing.
Step 5
Upon completion of the hearing phase, the arbitrator or panel chair will render his or her decision detailing the findings and ruling not later than 30 days from the close of the hearing or from the end of any time period permitted by the panel for the filing of other materials. The decision will be forwarded to the Committee which shall serve a copy of the decision on each party to the arbitration.
